Making a claim for compensation following an accident in a supermarket car park

Due to the amount of vehicles in a car park and a lack of designated pavements where shoppers are loading and unloading their cars, there is a heightened likelihood of a car accident. If the cause of the accident is due to a failure of a driver or a pedestrian than insurance claims would be followed in the normal channels. However if it is deemed that the accident took place due to the fact that the supermarket had failed to adhere to its duty of care then you can make a claim against the supermarket.

How you may have been affected

If the accident involves a vehicle, there is a likelihood injuries will not be so serious as on a normal road as cars are likely to be going at a slower speed. However, previous claims have included whiplash, fractures, broken bones, and concussion. As well as there being a possibility of trauma and distress following the incident it could lead to days, maybe weeks off work with a loss of pay; an inability to fulfil daily tasks (and so require the input of a carer); health treatment may require doctors and hospital appointments as well as costly medication.

What should they have done

In order for the supermarket to fulfil their duty of care and ensure your safety on their premises, management needs to ensure that the car park is kept to a high standard of repair, that it is free from hazards, and that workers and assistants keep to safety guidance regulations to ensure their behaviour does not facilitate an accident. If you can establish that the accident occurred due to negligence of the supermarket, you can make a claim for personal injury compensation against the supermarket’s public liability insurance policy.

What should you do after a car park accident?

When an accident occurs you may well not be in a good state of mind to capture important information about the incident. Of course the most important factor is to seek immediate medical advice. If a vehicle is involved you should also take insurance details and addresses as you normally would. As well as this:

  • Ensure the accident is reported and recorded in the supermarket accident book.
  • If possible take a photograph of the scene of the incident.
  • Get the names and addresses of any witnesses.
  • Keep receipts for everything you might reasonably feel you have incurred as a result of the accident. This may include medication, travel expenses, records of loss of earnings etc.
